Last month, the ABA's Council Section of Legal Education and Admissions to the Bar adopted a resolution to support the Uniform Bar Exam. According to the ABA Journal, Missouri and North Dakota have already adopted the Uniform Bar Examination; and Arizona, Colorado, Minnesota, New Hampshire are considering doing so (see http://www.abajournal.com/news/article/aba_group_backs_uniform_bar_exam/) .What is the UBE and how does it differ from the MBE?
The Multistate Bar Exam (MBE) is actually 1 component of the UBE. In addition to the MBE, the UBE also includes the Multistate Essay Exam (MEE), and the Multistate Performance Test (MPT).
Why should we or shouldn't we adopt the UBE?
While many states will accept a passing MBE score from another state, most attorneys are required to take the essay portions of a state's bar exam whenever they move (unless they meet the requirements for waiving in).
Supporters of the UBE believe that having one bar exam for all 50 states will make it easier for lawyers to practice, no matter where their careers take them (similar to the European Union's way of doing things). However, those against the UBE believe that due to the number of differences between state laws, states should continue to administer separate bar examinations.
